A Loveland man was sentenced Friday for driving while under the influence and killing his passenger in August.
Dylan Brown, 21, was sentenced to eight years in community corrections, whose programs range from a residential facility to community supervision and other treatment. He pleaded guilty to vehicular homicide, DUI in November.
On Aug. 9, Brown was driving south on Taft Avenue when his pickup ran into a traffic pole at the intersection of South Taft Avenue and Carlisle Drive at 2:17 a.m., according to previous Coloradoan reporting.
The female passenger, Bobbi Gonzales, was ejected from the truck and declared dead on the scene. The coroner’s office ruled the cause of her death as multiple blunt force injuries.
Brown and Gonzales were dating at the time of the accident, according to Friday’s testimony.
Brown’s attorney, Craig Mastro, argued for community corrections, citing Brown’s clean record and remorse. Deputy District Attorney Luke Birky requested a prison sentence, citing Brown’s 0.09 blood alcohol content and 5.6 nanograms of THC in his system at the time of the accident.
Family members of both Brown and Gonzales testified. Brown’s mother described him as kind, thoughtful and sensitive.
Gonzales’ father called it an “absolute slap in the face” to his family if the judge chose to sentence Brown to community corrections.
“He has to do some time. My daughter is dead,” he said, visibly upset.
After taking a recess, Judge Villasenor declared his sentence, saying his decision was guided by the concept of mercy.
Immediately after hearing the sentence, Gonzales’ father walked out of the courtroom, visibly angry.
